Client — an individual who has submitted an application to participate in a travel program, as well as third parties on whose behalf the Client acts, including children.
1. General Provisions
1.2. Travel services include excursions, tours, transportation, transfers, accommodation, flights, as well as related services provided by the Company and its partners.
1.3. Booking confirmation — the process of providing personal data, confirming participation, and making a deposit or full payment.
1.4. Standard tour price — the price excluding airfare and additional services.
2. OBLIGATIONS OF THE PARTIES
The Company undertakes to:
- Provide detailed information about tours upon the Client’s request;
- Book services according to the Client’s application;
- Ensure communication and delivery of documents (e-tickets, instructions) via email or messengers;
- Notify the Client of changes to the route, schedule, or other key tour details;
- Protect the Client’s personal data in accordance with the Privacy Policy and applicable law.
The Client undertakes to:
- Provide accurate information about themselves and all tour participants;
- Make a deposit of 50% of the standard tour price plus airfare (if applicable) and additional services;
- Stay in contact before and during the tour and arrive on time at the meeting point;
- Have a valid insurance policy for the entire duration of the trip;
- Follow safety rules and respect local customs;
- Notify the Company of cancellation no later than 5 days before the tour (10 days for VIP tours, such as Komodo).
3. CANCELLATION AND REFUND POLICY
- If canceled by the Company — 100% refund.
- If canceled by the Client less than 5 days before the tour — 50% of the standard tour price is retained.
- For VIP tours (e.g., Komodo), if canceled less than 10 days in advance — 50% is retained.
- Air tickets and additional services are non-refundable if the carrier/suppliers’ rules do not allow refunds.
- In case of cancellation due to reasons beyond the Company’s control (illness, weather conditions, lateness) — refunds are not provided unless otherwise agreed in advance.
4. SPECIAL CONDITIONS
- A tour may be canceled if the minimum number of participants is not reached. In this case, the Client may choose: rescheduling, a tour replacement, an individual format with an additional fee, or a full refund.
- Failure to appear or arriving more than 10 minutes late at the meeting point is considered a cancellation.
- Some tours require the Client to reach meeting points independently.
- Guides may be Russian- or English-speaking — please уточняйте at booking.
- The Company reserves the right to modify the program (excursions, timing, sequence) for valid reasons; the Client will be notified.
5. LIABILITY
The Company is not liable for:
- Flight delays, traffic conditions, actions of authorities, or force majeure;
- Program changes due to circumstances beyond control;
- Refusal of carriers or service providers to issue refunds;
- Services provided by third parties and their quality;
- Cultural differences in service standards.
The Client is liable for:
- Accuracy of the provided information;
- Timely payment for the tour;
- Compliance with instructions and participation rules.
The Company may limit its liability to the amount paid by the Client for the services, unless prohibited by law.
6. ADDITIONAL PROVISIONS
- The Client acknowledges that sightings of wild animals (manta rays, Komodo dragons, etc.) are not guaranteed.
- Some services may be provided by the Company’s partners, and the Client agrees to comply with their terms.
- The Client consents to the processing of personal data in accordance with the Privacy Policy, including cross-border transfer and storage in different jurisdictions.
7. PAYMENT AND CURRENCY
- The primary payment currency is Indonesian Rupiah (IDR).
- Payment in cryptocurrency or rubles is possible via verified exchange partners.
- Refunds are made in the same currency and by the same method used for payment, minus applicable fees.
- If payment is partial, the remaining balance must be paid before the tour begins.
- The Company is not responsible for exchange rate fluctuations when payments/refunds are made via exchangers.
8. TERM OF THE AGREEMENT
This Agreement comes into force upon booking confirmation and remains valid until completion or termination of the tour. Obligations related to liability and data processing remain in effect after the tour until fully fulfilled.
9. PERSONAL DATA
The Client confirms that they have reviewed the Privacy Policy and consent to the processing of personal data (name, contact details, passport data, etc.) for the purposes of performing this Agreement and (with consent) marketing. The Company undertakes to securely store data, use it only for stated purposes, and provide rights of access, correction, and deletion.
10. FORCE MAJEURE
The parties are released from liability for failure to perform obligations due to force majeure, including natural disasters, pandemics, actions of government authorities, and other circumstances beyond reasonable control. The affected party must notify the other party as soon as possible.
11. COMMUNICATION
- Support is available from 11:00 to 23:00 (Bali time).
- All instructions and tour details are provided in writing (messengers, email).
- In emergencies, the Client must immediately contact the guide or a Company representative.
12. FINAL PROVISIONS
- Payment of the booking constitutes full acceptance of the terms of this Agreement.
- If any provision is deemed invalid, the remaining provisions remain in force.
- Disputes are resolved through negotiations; if unresolved, they shall be settled in accordance with the laws of Indonesia in the courts of Indonesia.
